Alhamdulillah.
I hope you're doing wonderful. Alhamdulillah.
Welcome back to the workers
workshop. Alhamdulillah.
As Allah says Subhanahu Wa Ta'ala, after
Allah says those who strive,
strive in our way. How do we strive
in the way of Allah? One of the
ways is we strive with devotion,
right? We push ourselves.
Allah says who does that? Allah will guide
them. And
the study of fiqh
is not the study of Islamic law. It's
the study of perfecting as best we can.
So we are commanded to worship Allah Subhanahu
Wa Ta'ala and then Allah provides us the
means to worship him, alhamdulillah.
And one of the means is through the
teachings of the Quran, of course. And secondly,
through the teachings of the Prophet
We have reached the chapter of Bab at
Tayam mum. We already talked about the 4
obligatory components of Tayam mum. And Tayam mum
is very powerful. It's a very important chapter.
On the surface, it may seem very simple,
but when it comes to the
kind of philosophy, falsafa
attashariyah
of Islamic law,
This chapter is extremely important. This chapter and
the chapter on Hayd administration,
as mentioned by al Qari Abu Bakr ibn
al-'Arabi.
And we said that the word Tayamu means
al kast,
right?
Intention,
seeking something, having an objective for something. And
we learn something really beautiful from this, that
with the niya of a person,
dirt becomes water.
SubhanAllah.
That with the niya saw lihah lillahi subhanahu
ta'ala
a person befadlila
yurayiratrab
ilalmaa.
You need that
with our intentions,
the material world
loses its definition
by the rahma of Allah Subhanahu Ta'ala.
SubhanAllah.
So Masha'Allah
is really incredible.
We also learned something else that
the Sharia
Islamic law rests between two things what's called
Al Azima
and Ar Rojas.
Azima are those things we have to do
in normal situations
like fasting the month of Ramadan. The ruksa
and those of you who understand Arabic, Ruksa
is actually a license
but here it means a dispensation a license
towards ease. If I'm sick in Ramadan,
the Ruhsa is I don't have to fast.
If I am travelling in Ramadan,
the Ruhsa is I don't have to fast.
If I have water, the Azima is wudu
and the rugsa is tayamum.
So we see that Allah Subhanahu Wa Ta'ala,
Ar Raziq Subhanahu Wa Ta'ala has provided us
everything we need to worship him. Now you
understand.
We read this already. Alhamdulillah
That the obligatory
components of Tayamum
are for
the niya,
right, to
of course cover the hands
and the face, alhamdulillah, to your wrists,
to hit
some source of earth, as we talked about,
means everything, right, On the face of the
earth with our hands once. And then, of
course, to touch one of those substances that
has
touched or is part of the face of
the earth in the Maliki school. So the
wall, the floor, you name it, this this
desk
right? The Quran says what means the form
Faiil
oftentimes
means what? Masood
Very similar to the word
sahi. I don't like when people say a
sound hadith. No. It is authenticated.
Sahi means musaha.
Then the sheikh, he says
he says,
He says that the sunin are 3. The
sunin
of Tayamun. Sunin, of course, is the plural
of sunnah.
The first is to follow the proper order.
Right, to follow the proper order.
The evidence for this is Qiyas Al Wudu
that is considered, you know, Sunnah to follow
the order of making Wudu
as the prophet did it. So
if someone says like, where's the daleel? I
want the evidence. It's very important to remember
as sunnis
As Sunnis.
We believe that the agreed upon evidence is
what Imam al Birji calls
Al Asl.
Right? It's
Quran, Sunnah,
Qiyas, and Ijma'ah.
And that's why we have to be very
careful
of Sunnis who
take out
and take out
from the discussion.
The ones who take out ijma' tend to
be the irresponsible
conservatives.
The ones who take out ijma' tend to
be the neo liberals.
SubhanAllah,
Yani, we have to be very careful that
Qiyas protects us from hyper liberalism
and that Ijma saves us and protects us
from falling into Hawa.
We can see from the philosophy of Islamic
law, subhanAllah, something incredible.
So when someone asks like, Tartib ul Mas'
how was that a sunnah?
This is how the prophet did it.
In wudu, so therefore the qiyas follows
the Tayamun. Why? Because Tayamun we say is
taharatun
naibetun
right is a representative form of purification
that
steps in when we are
unable to make wudu. We'll talk about that
more in the future
Insha'Allah. The second sunnah wal mashu minalqawayi
ilal Mirfaqi.
This is something maybe you haven't heard before
but it is to
wipe from the wrist.
Right? From the the wrist all the way
to the elbow.
So I'm
making I don't stop here.
I wipe all the way here. This is
in
the
according
to the
Right? The predominant opinion.
We say the mashhur
Right?
Most of the people supported it, and it
has strong
evidence. But that's not gonna hold water here,
as we're going to see in a second.
And I may give you an opinion that
goes against what's considered Mashhur in the school.
Follow the school. Right? If you feel comfortable.
By no means would I ever attack that
but I also want to expand our mind
and allow us to move away from fanaticism.
As Sheikh Ahmed Taharayan said to me, we
are not
Muhammad
Sallallahu Alaihi Wasallam.
I studied with him
for 6 years. Allahu Akbar.
We did the khalil, we did sharhassareer,
we did the Muata. Mashallah with the Sheikh.
May Allah bless him and give him the
highest level of gender Alhamdulillah.
What is the evidence for this?
Sheikh Al Rumari, he actually wrote a very
very awesome text, which gives all the evidences
for
al Ishmaawiyah. Although sometimes he gives evidences that
the madhab doesn't use, but we don't need
to talk about that in this course, insha
Allah, because we want to make it
easy
for everybody.
But this is because of a hadith related
from Sayyidina
Amrrah
who says that the Prophet said,
The hadith is rated by Imam Dara
Dara Kutni.
That it is related that Sayna Amar said
that the prophet said that
is 2 strikes.
Right? Meaning here. Right? So boom boom.
Then again from here to here.
This Hadith is related by the daughter
Kutni.
That, you know,
that that some some scholars, they said this
hadith is sound and he agreed with him.
A sheikh, he says everything that's been related
that says this actually is not strong.
It's not Sahih. It's
So the sheikh is saying listen it's not
farmed.
That's why it's in the Sunan.
Even though it's phrased in this way because
of the weakness of the hadith, but at
the same time it is put under the
sunan because in the usul of the Maliki
madhab and this is something
that has been kind of clouded in recent
years. It is allowed to use a hadith
that are not super weak.
And we see people practicing them in their
early generations in fiqh, not just in fada'il.
