I bear witness that there is none worthy
of our worship except Allah, Subhanahu Wa Ta'ala,
and I bear witness that Muhammad, salallahu alayhi
wa sallam, peace be upon you, is the
seal of the prophets and the final messenger
to all of humanity. Whomever Allah, Subhanahu Wa
Ta'ala, guides, there is none to misguide him.
And whomever Allah
needs to go astray, there is none to
guide
So today, inshallah, we'll be talking about
a very,
important and vital topic.
The topic is a in the Islamic will
and testament.
So those of you who fall asleep in
the footpath, please pay attention for just 10
minutes.
So when we talk about the last will
and testament from a Muslim perspective or what
we call wasiyyah in Arabic,
So we mean the plan
of action
for what to be done after the person
leaves this life in terms of the funeral,
the debts, the money he owes or she
owes, and so on and so forth.
By, we mean the plan for what to
be done after the death. We all hear
about sudden death. Someone is alive and healthy
and everything, and all of a sudden, the
person dies. We heard a lot of stories
of youth and brothers and sisters
who work with us
in the last 2 years. And today, they're
not with us anymore. And the stories have
so many. There's no need to give examples.
We ask the most
to forgive all of them.
So once the person dies and he or
she was not expecting death, nobody knows what
to do. How to do this funeral, what
to do with their debts and their money.
And we don't know if they owe money
or they owe somebody debts or anything. We
don't know nothing.
Because the brother or the sister, he was
not expecting death, so he didn't make his
maseeb.
Also, some of us, they live here in
this country
by themselves.
Their families live back home, 10000, 15,000
miles away. So once the person dies, nobody
knows anything about them. We don't know who
to contact, who who to call back from,
and where to call. Nobody knows anything.
And also, those of us who live here,
and they work
anywhere or they work at Fort McMurray or
what they call Fort McMurray.
Okay? So they make lots of money,
but when they die,
who is gonna take their money? The Canadian
government will take most of the money, and
their families who live back home, they're not
taking anything unless they have to to fight
to take it to the court and fight
to get your money.
Also, the parents,
they're going somewhere, they're shopping, whatever, they're driving
their car and their kids at school and
accidents happen. Who's gonna take care of the
kids?
Most likely, the government would put them for
adoption and somebody would take them. Maybe a
Christian family, a Hindu family. Nobody knows.
So you have to make sure you leave
your kids in reliable hands before you leave
because you don't know this family. Nobody
knows.
But sometimes, and we hear about this all
the time. Yeah. I mean, a lot of
our brothers, they get married to non Muslim
ladies, especially Christian ladies when they come to
this country.
So once the person dies, his wife, who
is not Muslim, she doesn't know what to
do. Then she might take the body to
the church, and they cry over you, in
the church.
Or in some cases,
and you probably heard of this, they cremate
the body.
Barbecue.
Okay? So they burn the body to save
some money. And this happens, and I heard
a lot of stories. So you have to
put in your will see what to be
done after your death.
So Allah, Subhanahu Wa Ta'ala, says in the
Quran in chapter 2, that Allah, Subhanahu Wa
Ta'ala, has ordained for you
before your death that you make a wafin.
If you leave something of value,
or if
you call it
that the prophet says that every Muslim
who has something of value
should not stay for 2 days without having
his wasi written with him.
Something of value. So Abdullah Nohmar radhiallahu
He said, my father came to me at
night and he said, I will probably be
the 1st to die tomorrow in the battle.
And I don't love anyone in this world
more than you except the prophet sallallahu alaihi
wa sallam. So I love the prophet sallallahu
alaihi wa sallam more than you. You're only
second.
I have a lot of debts, so you
need to pay them if I die. And
take good care of your brothers and sisters.
So Jabez Adelai said, the first thing in
the morning when the battle started,
my father was the first one to die
in the battle as he himself predicted.
So he said, I buried him,
and they brought another man, and they buried
him next to my father in the same
grave. So he said, I didn't feel good
about my father being buried with, someone
else, so I decided to undock or undig
my father and bury him somewhere else. So
when he said, when I opened the grave,
I found my father 6 months later,
in the same condition that I buried him.
The whole body was the same exactly
just like
I buried him, like, a minute ago. It's
the same thing.
So the first thing to be written in
the what
to be done at your funeral? Who to
wash you and who to bury you and
who to leave the for you? And you
should also tell people what to do
in the Tell him to do good things
and to give salam on your behalf
and to forbid doing bidah or innovations or
to do terrible cultural things that have nothing
to do with the religion in your Janazah.
And number 2, you put your belongings in
terms of money,
land, houses.
If somebody owes you money, your bank accounts,
you have to put all this in your
you write down what you owe other people,
like debts. So if you also buy some
money, tell your family, I owe this person
that much and I owe that person that
much, so pay them your vows in the
noon.
And, also, if you haven't paid the dawah
to your wife, make sure that your family
pays the dawah.
Two conditions here. Number 1, it has to
be within 1 third of your money. And
number 2, it should not be for someone
who already takes a share from your inheritance.
And the prophet
says, there's no bequest for someone who already
takes a share from the
So it has to be within the 3rd,
and again, there's no obligation to bequest
money. It's optional if you want to get
the reward. So in this authentic hadith, Salil
Nabi waqalimbuqalim,
he asked the prophet, he said, if he
can't give all his money in charity, The
prophet, sallallahu alaihi wa sallam, said no.
2 thirds? No. 1 half? No.
1 third? The prophet, sallallahu alaihi wa sallam,
says, yes. 1 third and 1 third is
too much. So give 1 third or less.
Then the prophet, sallallahu alaihi wa sallam, says,
it is better
to leave your ears, your children, and family,
and your mother, and parents, and so on
and so forth. It is better to leave
them rich than to leave the poor begging
people for money. That's Allah Subhanahu Wa Ta'ala.
So you have to maintain justice when you
do the wasiyeh. You shouldn't give some of
your children more than others. You have to
keep justice between them. The prophet says in
this authentic hadith in Muslim of Abi and
Muslim Imam Ahmad, it's an authentic hadith
that some of you
may live for 70 years, and they do
righteous deeds all the time. They're good people.
But before they die, they make a and
they don't give everyone their rights. They give
to some, and they withhold from others. So
they give to some of their children, for
example, and they prevent others. They deprive them.
So this person within his life with an
evil deed, then he will be punished as
a hellfire as the prophet
